Mediation: The couple goes through mediation before a neutral mediator, generally with the assistance of counsel, to arrive at an amicable, equitable settlement.

Litigation: The parties, for a variety of reasons, are unable to successfully mediate to resolve issues and end up litigating all or a portion of their disputes. After a trial of initial issues, an intractable spouse may realize the benefits of mediation and choose to use it to resolve further disagreements.
